Inmigración altamente cualificada y mercado de trabajo europeo: la nueva Directiva (UE) 2021/1883

Abstract

En un mercado global tan competitivo, la Unión europea necesita ser atractiva para las personas trabajadoras altamente cualificadas. Ahora bien, tratándose de ciudadanos de terceros países esta necesidad debe hacerse compatible con las políticas sobre el control en las fronteras, asilo e inmigración. En este difícil equilibrio entre la atracción y el control, la Directiva 2009/50, que establecía las condiciones de entrada y residencia de nacionales de terceros países con fines de empleo de alta cualificación, ha sido derogada por la nueva Directiva 2021/1883 que amplía el ámbito subjetivo y objetivo de la anterior, proporcionando más ventajas para esta modalidad de empleo. Este trabajo recoge las novedades de la nueva Directiva a la par que analiza su impacto en el Derecho interno español que, como es sabido, comprende dos sistemas de acceso: el de la Directiva 2009/50 que ha sido transpuesta en la LO 4/2000 y el de la Ley 14/2013.

The European Union needs to become more attractive to highly qualified workers and, for those coming from third countries, this should be done by implementing consistent border control, asylum and immigration policies.In order to find a balance between talent attraction and immigration control, Directive 2009/50, which established entry and residence for third country nationals, has been repealed by the Directive 2021/1883 which will expand the subjective and objective scope of the previous one by providing more advantages for this type of employment.The attached work gathers the changes featured on the new Directive, analysing its impact on Spanish domestic Law and its two legal channel for employment applications: Directive 2009/50 transposed into LO 4/2000 and Law14/2013
