Abstract

This paper starts opposing the bank-based and the non-bank based models of microfinance institutions, in order to understand the origin and evolution of global microfinance. In particular, the effects derived from the absence of regulation within the scope of the non-banking model are hereby analyzed, to conclude in the need of a legal discipline for lending microfinance institutions. An European comparative-law brief panorama and a proposal of such regulation are posed herein too. Such proposal is based upon the previous work of the Regulation Working Group of the Asociación Española de Microfinanzas, the most important in the Spanish microfinance sector.

Este trabajo contrapone en primer término los modelos bancarios y no bancarios en el origen y evolución global de las microfinanzas, examinando en particular los efectos de la falta de regulación en el modelo no bancario en sus sectores semiformal e informal. Se concluye en la necesidad de regular en España las instituciones microfinancieras prestamistas, y se hace un breve recorrido de derecho comparado antes de realizarse una propuesta concreta regulatoria para nuestro país, sobre la base de la que ha realizado el Grupo de Trabajo de Legislación Microfinanciera de la Asociación Española de Microfinanzas
