Abstract

El control de transparencia material al que están sujetas las cláusulas que forman parte del objeto principal del contrato, hasta ahora de desarrollo eminentemente jurisprudencial, se positiviza en el actual Proyecto de Ley reguladora de Contratos de Crédito Inmobiliario. El cambio de contexto político en mitad de la tramitación de la norma hace que la revisión de las enmiendas planteadas al texto cobre un especial interés. Por ello, tras una exposición de los aspectos esenciales del régimen del control de transparencia material y de su aplicación por los tribunales en referencia a las cláusulas suelo, préstamos con cláusula en divisa extranjera y cláusulas índice IPRH, en el trabajo se examinan y valoran las propuestas de modificación planteadas por los Grupos Parlamentarios en esta materia.

The control of material transparency linked to the clauses referring to the main object of the contract -developed by the jurisprudence so far- is regulated by the Draft Law on real estate credit agreements. The change of the political context while being negotiated makes the analysis of the amendments proposed to this text highly interesting. Therefore, after explaining the basic rules on the control of material transparency and its use by the courts, the main amendments to the mentioned Draft Law will be examined and evaluated.
