El derecho a la salud: un derecho social esencial

Abstract

El derecho a la salud es considerado habitualmente como de carácter esencial, aunque paradójicamente no haya tenido el adecuado reconocimiento constitucional y legal. Frente a la clásica distinción entre derechos de libertad y derechos de igualdad, la justificación más actual del derecho a la salud parte de la noción de necesidades básicas, conceptualizadas como básicas, objetivas, generalizables e históricas. Del debate doctrinal, se puede concluir que las necesidades básicas serían consideradas como razones para la acción, algo necesario aunque no siempre suficiente para el surgimiento de obligaciones morales o legales. En la Constitución española de 1978, la relación que mantienen el derecho a la protección a la salud (art 43) y el mantenimiento de un régimen público de Seguridad Social (art 41) es de coimplicación. Ambos se conciben como derechos prestacionales que generan obligaciones positivas por parte del Estado. El sistema sanitario español se basa en los principios de universalidad, solidaridad y equidad.
