El TEDH está contribuyendo al reconocimiento de la Gestación por subrogación. El tribunal ha venido afirmando criterios sólidos para proteger el interés superior del menor y reconocer la filiación de los padres cuando hay algún vínculo biológico, y además se hayan desarrollado en el tiempo lazos afectivos como los lazos propios de una convivencia familiar entre los padres de intención y el niño. Aquí mostramos la línea de actuación del TEDH hasta los últimos casos en marzo y abril de 2022.
ECHR is contributing to the recognition of surrogacy. The Court has been affirming solid criteria to protect the best interests of the minor and recognize the filiation of the parents when there is some biological link, and in addition affective ties have been developed over time, such as the ties of a family coexistence between the intended parents and the child. In this paper, we show the line of action of the ECHR until the last cases in March and April 2022.
