La adaptación de condiciones de trabajo y sus límites

Abstract

El presente trabajo se centra en la delimitación del ejercicio del poder empresarial en la ejecución del contrato de trabajo con el fin de lograr un equilibrio entre la inserción del trabajador en una organización productiva y la facultad empresarial de adaptación de los recursos productivos. Para conseguir este objetivo se exponen los principales límites a los que el poder de dirección empresarial se encuentra sometido. Se comienza por el análisisdel ius variandi como límite objetivo. Bajo este concepto jurídico, a pesar de la mayoritaria doctrina jurisprudencial, se entiende que anidan los supuestos en los que el empresario realiza modificaciones extraordinarias, más allá del contrato de trabajo, llegando a introducir cambios sustanciales que precisan la concurrencia de una de las causas especificadas legalmente. Su delimitación permite estudiar las facultades empresariales ordinarias de adaptación de condiciones de trabajo atendiendo a la reciente doctrina jurisprudencial. Parafinalizar, se aborda el estudio del principal límite subjetivo, la dignidad humana. Consecuentemente se analiza el acoso laboral, como límite al margen de actuación regular del ejercicio del poder de dirección en la adaptación de condiciones laborales y, del mismo modo, las consecuencias indemnizatorias que supone el hecho de traspasar dicha frontera
