The work addresses the question of the judicial creation of Law. It is claimed that it is a problem that can be approached both from a theoretical point of view, and from an empirical point of view, as well as from a moral point of view. The text concludes with a positive answer on the question of whether judges create norms and underlines the importance of controlling this activity.
