Derechos sociales: Un enfoque multinivel

Abstract

El artículo, a partir del examen de las principales contribuciones que han caracterizado el debate recientemente, propone algunos apuntes para situar la cuestión de los derechos sociales en una dinámica de promoción de la democracia “desde abajo”, en el interior de los Estados nacionales, pero también aumentando la perspectiva a una óptica planetaria. El sentido argumentativo, y la intencionalidad que lo alimenta, es el de una “democratización” de la democracia misma como alternativa a los procesos de “de-democratización”, dirigidos por la “promoción ilimitada del individualismo” y por la “privatización de las funciones y de los servicios públicos”. Los derechos sociales, plenamente “derechos fundamentales” y “derechos humanos”, son concebidos como “indivisibles”, “interdependientes”, “interconectados”, respecto al resto de derechos fundamentales (tal y como se establece en la Declaración de Viena de 1993); para garantizarlos, es necesario que estén radicados “conceptualmente” dentro de un espacio social e institucional que hoy sólo puede ser “multinivel” pero que, al mismo tiempo, no puede prescindir del poder regulador y práctico de los Estados y de las instituciones territoriales, justo a las reivindicaciones que se movilizan y llevan a cabo en estos espacios.
