Abstract

Der Tod eines Schuldners stellt den Gläubiger vor eine Herausforderung: Er verliert die Person, an die er sich zur Durchsetzung seiner Forderung halten kann. Das römische Recht bot dem Gläubiger eine Lösung, indem es die Erben grundsätzlich durch Universalsukzession in die Verbindlichkeiten des Erblassers eintreten ließ. Doch es gab zahlreiche Fälle, in denen das Konzept der Erbenhaftung allein nicht ausreichte, um die Gläubigerinteressen hinreichend zu schützen – etwa wenn die Erbfolge aufgrund einer bedingten Erbeinsetzung über längere Zeit unklar blieb. Während die bisherige Forschung den Erbfall meist aus der Perspektive der Erben betrachtet hat, richtet diese Studie den Blick auf die Gläubiger. Sie zeigt, dass das römische Recht die Interessen der Gläubiger keineswegs vernachlässigte, und führt auf dieser Grundlage zu neuen Interpretationen altbekannter Texte.
