Abstract

Tesis (Magíster en Derecho LLM, Mención Derecho Tributario)--Pontificia Universidad Católica de Chile, 2018 ; El objetivo de esta tesis es reconocer el rol que la cláusula de Beneficiario Efectivo puede desempeñar en los Estados al momento de hacer frente a la elusión fiscal, y en particular, identificar el papel que la cláusula tendría en la aplicación de una Norma General Anti Elusión (NGA) o General Anti Avoidance Rules o GAAR. Para argumentar la solución a la hipótesis la tesis realiza un análisis de los tratados internacionales, las normas legales locales y la jurisprudencia administrativa del Servicio de impuesto internos. Lo anterior, también tomando como base el derecho comparado y el derecho internacional, utilizando como base el análisis de los Comentarios de la OCDE, ONU, la normativa de la Unión Europea, la normativa BEPS y la Normativa general antielusión en Chile. La investigación se encuentra focalizada en el término Beneficiario efectivo, analizando el conjunto de normas antielusivas. Se hace uso de la doctrina internacional, el derecho comparado y la forma en que otros países han conciliado la expresión Beneficiario efectivo con su derecho interno.
