Abstract

La intersección entre la libertad religiosa (LR) y la inteligencia artificial (IA) plantea un desafío significativo en la actualidad, dado el creciente uso de tecnologías automatizadas en la toma de decisiones. Este estudio examina cómo los sistemas de IA, especialmente aquellos algoritmos que utilizan el big data, pueden afectar los derechos de LR tanto en contextos online como offline. Se argumenta que el diseño y la implementación de algoritmos deben considerar las particularidades culturales y religiosas de las comunidades, a fin de evitar la discriminación y el sesgo en las decisiones automatizadas. Se evidencia que la IA puede convertirse en una herramienta de vigilancia que amenaza la expresión de la diversidad religiosa, reproduciendo estigmas y aumentando la marginación de ciertos grupos. Se proponen adaptaciones de los Principios Rectores sobre Empresas y Derechos Humanos para guiar a las organizaciones en la integración de la LR en sus prácticas algorítmicas. Las recomendaciones incluyen revisar el marco legal de los derechos humanos en relación con la LR, mapear el terreno legal local, y realizar evaluaciones de riesgo que consideren las variables culturales y sociales pertinentes. Además, se enfatiza la necesidad de un monitoreo humano en el desarrollo de sistemas de IA para garantizar que se respeten los derechos individuales. En conclusión, es esencial que las iniciativas de IA no solo promuevan la innovación tecnológica, sino que también respeten y protejan la LR como un derecho humano fundamental en la era digital.
