Abstract

En el Perú, los organismos reguladores de servicios públicos han adoptado tradicionalmente esquemas de comando y control que priorizan la corrección de incumplimientos normativos mediante sanciones, en lugar de utilizar mecanismos menos invasivos. Esta situación ha generado un deterioro en la relación entre el Estado y las empresas reguladas, así como un contradictorio incremento en el índice de incumplimiento de las obligaciones regulatorias en algunos sectores. En el presente trabajo se analiza la capacidad disuasoria de las medidas correctivas como alternativa a las sanciones, y se propone un marco metodológico predecible para su aplicación.
