Abstract

El derecho al trabajo tiene una larga historia anterior no solo a 1848, momento de su popularización, sino también a 1789. Sus orígenes se remontan al siglo XVI, cuando el ius laborandi expresa tanto el derecho a trabajar a perpetuidad como el derecho a la labranza en tierras ajenas. Entre la segunda mitad del XVII y la primera del XVIII, el droit de travailler sirve para denotar los derechos de los maestros que pertenecen a un gremio. A partir de la segunda mitad del XVIII, la expresión es usada por los fisiócratas en su crítica al sistema gremial. En la misma época, aunque de forma esporádica, se encuentran las primeras apariciones de la fórmula droit au travail. Durante la Revolución Francesa, esta última noción se emplea para hacer referencia al derecho a la asistencia a través del trabajo. Es un antecedente claro del droit au travail del que habla Fourier a principios del siglo XIX.
