Abstract

El trabajo examina las principales teorías que se han formulado para legitimar los delitos de peligro abstracto; esto es, la criminalización de comportamientos que, en general, crean un riesgo para bienes indeterminados, aunque pueden presentarse circunstancias particulares en las que una conducta de esa clase no ocasione tal peligro. Luego de analizar críticamente diferentes propuestas de legitimación, se defiende la perspectiva que concibe a dichos delitos como presunciones rebatibles. Si bien este enfoque ha sido defendido con anterioridad, el trabajo presenta argumentos que permiten comprender más acabadamente sus virtudes como también responder a las objeciones que se plantean en su contra. Concretamente, se argumenta que la concepción de los delitos de peligro abstracto como presunciones rebatibles puede maximizar los beneficios de recurrir a esta técnica legislativa, ya que aprovecha en buena medida las ventajas que otorgan las reglas, sin incrementar sustancialmente las situaciones de injusticia material.
