A VERDADE NO PROCESSO JUDICIAL: A FALÁCIA DA VERDADE METAFÍSICA

Abstract

O procedimento judicial e pensado nos termos da racionalidade apoditica, como demonstracao ao inves de convencimento. Essa perspectiva e heranca da abordagem teologica e metafisica da verdade que, transferida para o Estado e o direito, ajudam a consolidar as categorias e formas que confirmam ambos. No entanto, a racionalidade retorica, resgatada atraves da preocupacao com a linguagem e a pluralidade do sec. XX, ensina que num processo dialetico que parte da duvida, como o processo judicial, nao e a verdade que se tem como produto, mas a verossimilhanca. Da mesma forma, o realismo juridico permite entender o processo de decisao a partir da perspectiva do magistrado, confirmando a ideia retorica de que processo e convencimento, nao revelacao da verdade.
