Abstract

L’istituto del domicilio fiscale è proprio del diritto tributario ed esprime quella relazione spaziale tra contribuente ed ente impositore che è necessaria ai fini della certezza dello svolgimento dei rapporti giuridici. La funzione principale del domicilio fiscale è quella di radicare la competenza territoriale dell’Ufficio tributario. Il domicilio fiscale individua, inoltre, il luogo in cui devono eseguirsi le notificazioni dei provvedimenti impositivi. Benché per sua natura il domicilio fiscale abbia carattere inderogabile, il legislatore prevede che, in deroga a quello predeterminato ex lege, l’amministrazione finanziaria, d’ufficio o su istanza di parte, possa stabilire il domicilio fiscale altrove. L’esercizio di tale potere, tuttavia, deve necessariamente uniformarsi al fine di pubblico interesse sotteso all’istituto che è quello di migliorare la funzionalità dell’attività impositiva.
