Abstract

Par l’entremise de l’interpretation des lois bilingues, la jurilinguistique permet aux tribunaux de mieux proteger l’egalite des communautes de langue officielle lorsque celle-ci fait l’objet d’une garantie legislative ou constitutionnelle particuliere. De telles garanties traduisent souvent ce que le constitutionnaliste americain Cass R. Sunstein appelle un « accord incompletement theorise », en ce sens qu’elles enoncent une norme juridique dont le constituant n’aurait pas fixe a l’avance toutes les implications conceptuelles et pratiques. Or, l’existence de deux versions du meme texte legislatif ou constitutionnel offre un champ semantique plus riche permettant d’apporter des nuances additionnelles qui peuvent, par la suite, aider a determiner la conception de l’egalite la mieux adaptee a l’objet de la garantie et aux circonstances du cas d’espece. L’importance d’une telle richesse semantique est particulierement bien illustree par l’arret Mahe c. Alberta de la Cour supreme du Canada, decision charniere eu egard au principe d’egalite en matiere de droits linguistiques, dans laquelle l’interpretation des lois bilingues a joue un role determinant. Dans cette optique, l’auteur du present article effectue un examen approfondi de l’arret Mahe dans le but notamment de souligner l’utilite d’une demarche qui voit dans l’article 23 de la Charte canadienne des droits et libertes l’expression d’un accord incompletement theorise.
