El principio de buena fe en el Derecho Internacional Público

Abstract

Este libro aborda el concepto de la buena fe en el Derecho Internacional Público. Para ello, en primer lugar se estudia la buena fe en el derecho general, considerando su etimología y evolución con el fin de identificar las bases ideológicas del concepto. Una vez en el ámbito del Derecho Internacional Público, se analiza su naturaleza jurídica, señalando que la buena fe constituye un principio explícito del sistema contemporáneo, al estar recogido en la Carta de las Naciones Unidas. Asimismo, el artículo 38 del Estatuto de la Corte Internacional de Justicia —documento anexo e integrante de la Carta— reconoce los “principios generales de derecho reconocidos por las naciones civilizadas” como fuentes del orden jurídico internacional, encontrándose entre ellos el principio de buena fe. Este principio también se manifiesta en diversas normas concretas sustentadas en los tratados y en la costumbre internacional. Más allá de su dimensión jurídica, la buena fe constituye un principio de civilización indispensable para preservar la coherencia y la legitimidad del sistema jurídico internacional.
