Abstract

Enquanto se aguarda a nomeação do novo ministro de nosso Supremo Tribunal Federal, sob a expectativa de se ter um magistrado oriundo da Justiça do Trabalho naquela Corte, se torna oportuno recordar um Juiz do Suprema Corte estadunidense que, em um período de extremo conservadorismo daquele Tribunal, ousou dissentir em questões essenciais referentes aos direitos decorrentes do contrato de trabalho, apresentando uma visão hoje talvez tida como simplesmente moderada, mas que na época foi de um arrojo ímpar.
