Abstract

A interpretação consiste em ferramenta indispensável à boa compreensão da norma que compõe o ordenamento jurídico, visando, sobretudo, a resguardar os preceitos da democracia social, ao levar em conta as condições sociais no momento da aplicação da norma, por meio de recursos aos métodos interpretativos. E os direitos sociais do trabalhador se destinam a garantir o devido amparo e proteção social àqueles que não dispõem dos recursos necessários para viverdignamente. Neste trabalho, procura-se desenvolver raciocínio a fim de demonstrar a importância de uma interpretação no Direito do Trabalho em conformidade com a realidade social brasileira. No direito, para alcançar os anseios de um povo, deve-se interpretar a lei de forma que gere a justiça social desejada. Destarte, a atualidade socio-jurídica aponta a inefetividade das normas fundamentais do trabalho, a crise da justiça social, a morosidade, o problema de acesso à justiça e a não-implementação dos direitos sociais, etc. E todos esses fatores se expressam pela absoluta falta de função social do Direito, ou seja, pelo cotejo entre o texto constitucional e o contexto social.
