Reforma trabalhista e efeito Cliquet

Abstract

O presente artigo se destina ao exame de questões relacionadas à flexibilização da jornada de trabalho à luz das modificações advindas da Lei 13.467/2017 e do efeito cliquet. Partiu-se de uma exposição acerca das características dos direitos sociais, em especial o viés do não-retrocesso, a fim de sustentar que não são viáveis juridicamente alterações lesivas ao trabalhador, vez que seus direitos se inserem no rol de direitos sociais. Em segundo lugar, analisou-se dois temas relevantes e que mostram o tom trazido pela reforma trabalhista: o banco de horas e a jornada de trabalho em regime intermitente. Por fim, concluiu-se que as alterações trazidas com a novel legislação trabalhista não são compatíveis com o ordenamento jurídico pátrio, possuindo incompatibilidades materiais com a Constituição Federal, Convenções Internacionais da Organização Internacional do Trabalho (OIT) e princípios gerais de Direito Juslaboral, além de afrontar o princípio da vedação ao retrocesso.
