Configuración típica de la responsabilidad penal en la mala praxis médica en Bolivia

Abstract

La mala praxis médica en Bolivia, en cuanto a su configuración típica, posee dificultades, ya que carece de una tipificación penal específica, obligando a subsumirla en tipos genéricos que no recogen las peculiaridades del acto médico ni la flexibilidad técnica de la lex artis. Esta situación genera dificultades para delimitar la responsabilidad penal, en especial en cuanto a la imputación subjetiva, generando conflictos para distinguir la conducta culposa del dolo eventual. La imputación objetiva debería basarse en la relación médico-paciente, en las expectativas puestas en el médico, su posición de garante, así como el carácter esencialmente riesgoso de la práctica clínica, aspectos que exigen un análisis preciso para establecer cuándo el profesional excede el riesgo socialmente permitido.
