Juicio por jurados y estereotipos de género

Abstract

El trabajo aborda la incidencia de los estereotipos de género en el proceso de juicio por jurados, especialmente en la selección y las instrucciones impartidas a los jurados, no solo en casos de violencia de género. Se analiza la audiencia voir dire como un mecanismo crucial para asegurar un jurado imparcial, y la importancia de incorporar la perspectiva de género en las instrucciones judiciales para evitar el sesgo en la valoración de la prueba. Este enfoque busca desarticular las creencias patriarcales que afectan la deliberación y el veredicto del jurado. Además, se examinan las normativas provinciales argentinas y los avances legislativos. Se aborda en particular los avances normativos en la nueva ley de jurados de la provincia de Santa Fe. Finalmente, se proponen buenas prácticas para mejorar la selección y capacitación de jurados, garantizando decisiones justas y sin prejuicios.
