Abstract

La entrada en vigor de la Ley Orgánica 1/2004, de 28 de diciembre, de Medidas de Protección Integral contra la Violencia de Género (en adelante, LOMPIVG), atribuyó competencias civiles en materia de derecho de familia a los juzgados de violencia sobre la mujer. Sin embargo, el hecho de que la redacción del artículo 87 ter.2 de la Ley Orgánica 6/1985, de 1 de julio, del Poder Judicial (en adelante, LOPJ), no se corresponda con la contenida en el artículo 748 de la Ley de Enjuiciamiento Civil (en adelante, LEC), así como que los criterios del art. 87 ter.3 LOPJ sean diferentes a los previstos en los arts. 769 y 779 de la LEC, ha determinado el planteamiento de numerosas cuestiones de competencia, que no pocas veces se han resuelto con criterios dispares y llegando a conclusiones contradictorias. En el presente trabajo, se analizarán las principales cuestiones que se han planteado en esta materia y se indicarán los criterios jurisprudenciales existentes en aras de resolverlas.
