Seguros de vida y suicidio

Abstract

En el presente trabajo se parte de una primera visión social y económica del seguro de vida para atender la problemática existente en relación con dichos seguros y la cobertura del suicidio, fundamentalmente con respecto al período de carencia y con la posibilidad de las partes de pactar su exclusión como cobertura. En relación con ello, la doctrina defiende la naturaleza de cláusula delimitativa, mientras en la mayor parte de las sentencias nos encontramos con su consideración como cláusula limitativa de los derechos del asegurado. Introducimos en ello una nueva visión mixta de estos supuestos. El mayor problema en esta materia parte esencialmente del análisis de los conceptos de voluntariedad y consciencia que desde 1962 el TS ha venido distinguiendo y en donde se pueden dar los supuestos más llamativos a efectos de fraude, aunque el asunto se sujeta, en la mayor parte de los casos, a una cuestión de carga probatoria.
