Abstract

La figura de la cesión de créditos, regulada en el Código Civil, está de actualidad en los últimos años debido a la crisis del sector bancario, lo que ha propiciado medias legislativas tras ser adoptadas las cesiones globales o de cartera a fondos conocidos como buitres. La legitimación de estos para actuar o continuar los procesos judiciales en marcha está siendo problemática, por las dificultades de adaptar la tradicional regulación a este fenómeno actual y específicamente el llamado retracto de créditos litigiosos. Se examina en esta ponencia el estado actual de la jurisprudencia desde la perspectiva de los procesos declarativos, al margen del proceso especial hipotecario.
