El derecho a la verdad sobre la desaparición forzada de personas

Abstract

El derecho a la verdad sobre la desaparición forzada de personas es un derecho autónomo, inalienable e imprescriptible que tienen las víctimas y que se refiere al derecho a conocer la suerte o paradero de las personas desaparecidas y, en caso de fallecimiento, el derecho a la restitución de los restos mortales para poderlos enterrar conforme a sus creencias y tradiciones. En España, con más de 114 000 personas desaparecidas y más de 2 400 fosas comunes, el Estado está vulnerando el derecho a la verdad de las víctimas al no llevar a cabo una investigación rápida y efectiva de las desapariciones forzadas y no desarrollar una política estatal de búsqueda, recuperación y restitución de los restos de las personas desaparecidas que se encuentran enterradas en el territorio, aumentando así el sufrimiento y la angustia de las víctimas que llevan años buscando a sus familiares desaparecidos.
