Las reformas procesales y sustantivas del año 2015. Su interpretación jurisprudencial

Abstract

El Código Penal y la Ley de Enjuiciamiento Criminal fueron objeto de modificaciones de calado en el año 2015, algunas de las cuales reclamaba una interpretación jurisprudencial, que delimitara con claridad su alcance y significado particularmente, por parte de la Sala de lo Penal del Tribunal Supremo. En este marco, el nuevo recurso de casación penal ha venido a reforzar el papel del Tribunal Supremo como unificador de la doctrina penal. Los nuevos cauces casacionales están facilitando pronunciamientos jurisprudenciales del Alto Tribunal sobre algunas de las nuevas figuras delictivas o sobre otras, no modificadas en el año citado, pero que habían sido interpretadas de manera discrepante por las Audiencias Provinciales. Su conocimiento detallado resulta imprescindible.
