Competencia judicial internacional en los procedimientos de familia

Abstract

El Derecho procesal civil internacional español se ha visto profundamente modificado en los últimos años por la intervención del legislador europeo, que ha introducido un sistema casi completo de reglas de competencia judicial internacional para supuestos intra-europeos. Ello ha tenido dos consecuencias importantes: por una parte, la necesidad de articular la aplicación de estas normas (entre sí y con otras nacionales o convencionales que coexisten con ellas); y por otra, la revisión de las reglas españolas en busca de una coherencia sistémica que no siempre consigue su objetivo. Ambas cuestiones se analizan aplicadas a los procesos transfronterizos de familia.
