Abstract

El DIDH está formado por tratados, costumbres y principios generales de Derecho internacional que imponen a España obligaciones precisas en el campo de los derechos humanos, primando sobre el Derecho interno. La Constitución española reconoce jerarquía supra-legal e infra-constitucional a las normas contenidas en los tratados internacionales ratificados y publicados en el BOE; tales normas son de aplicación directa por los tribunales de justicia. En caso de conflicto con una norma de Derecho interno, la interpretación de los derechos consagrados en la Constitución se debe realizar de conformidad con lo establecido en la Declaración Universal de Derechos Humanos y en los tratados que hayan sido ratificados por España. El recurso de revisión permitirá solicitar al Tribunal Supremo que rectifique su fallo si la condena procediera del Tribunal Europeo de Derechos Humanos, pero el vacío legal persiste para asegurar la ejecución en España de decisiones de órganos internacionales de naturaleza cuasi-contenciosa, si bien los tribunales nacionales deben ejercer un control de la convencionalidad. El DIDH reconoce a las víctimas de la Guerra Civil y de la dictadura franquista el derecho a la verdad, la justicia, la reparación y a obtener garantías de no repetición.
