Las entradas y registros en el domicilio de los obligados tributarios: algunos apuntes desde la visión de la Administración Tributaria

Abstract

En esta materia de la entrada en domicilio y demás lugares dependientes de la voluntad de su titular, hay pocas normas. Tenemos el artículo 18 de la Constitución y los artículos 113 y 142 de la Ley General Tributaria y poco más. Esta son casi las únicas certezas que tenemos. A partir de ahí, lo que hay son construcciones doctrinales y jurisprudenciales. Pese a que se trata de cuestiones doctrinales y jurisprudenciales y hay pocas normas, se puede decir que tampoco están tan distantes las posiciones de la Administración Tributaria y la de los contribuyentes. Tampoco la de los tribunales. En algunos puntos hay discrepancias pero no se puede decir que, en conjunto, las posiciones sean distantes. Ello es así porque en esta materia los problemas no son tanto jurídicos o teóricos sino que son más bien de aplicación práctica al caso concreto.
