Abstract

La gestión de los medios personales de una Administración Pública permite reconocer el avance de una sociedad. El régimen dual del empleo público en España se traduce en una similar dualidad en el sistema de negociación colectiva. Una negociación colectiva conjunta permitirá introducir las necesarias dosis de racionalidad y eficacia en la gestión de los recursos humanos y para unificar en la medida de lo posible o, al menos acercar, las condiciones de trabajo de todo el personal. El EBEP ha consolidado tímidamente esta posibilidad, pero algunas dificultades han de ser aún superadas: la inercia histórica y la diversidad de orden jurisdiccional para la impugnación de los Pactos y Acuerdos. La práctica negociadora profundizando en esta vía facilitará el avance.
