Crítica de una perspectiva judiciaria, moralista y liberal de la guerra. Análisis del ensayo: El crimen de la guerra, de Juan Bautista Alberdi

Abstract

Teniendo por tema la guerra –y la paz– desde el punto de vista de Juan Bautista Alberdi (1810-1884), este escrito se detiene en una de sus obras: El crimen de la guerra (1870). En esta dirección, el objetivo general es contribuir al esclarecimiento de las formulaciones “alberdianas”. Al tiempo que los objetivos específicos a concretar son: examinar minuciosamente el material citado; determinar sus trazos más significativos; y, ponderar concienzudamente los argumentos vertidos. Por su parte, dos son las preguntas que traccionan el artículo: ¿En qué consiste el constructo teórico desarrollado sobre la guerra –y la paz?, y ¿Qué evaluación merece? Las hipótesis que aspiran a responderlas aseveran que: en primer término, se trata de un entramado judiciario, moralista y liberal, con ribetes evolucionistas-supremacistas, mientras que, en segundo lugar, tanto la capacidad explicativa como el alcance de su instrumentalización son inconsistente y deficitario, respectivamente. Palabras clave: deslizamientos, criminalización, judicialización, formalista, esencialista.Recibido: 19/3/2026 – Aceptado: 26/6/2026
