Lecciones del caso chagosiano: movilidad forzosa y tensiones internas del derecho internacional

Abstract

El principio de libre determinación de los pueblos, es una herramienta jurídica indispensable para el respeto a los Derechos Humanos, en tanto propende la emancipación política de pueblos subyugados. Sin embargo, dada la forma de creación del derecho internacional público, el principio ha sido manipulado por parte de Estados coloniales para utilizarlo como un argumento funcional a sus intereses y no como instrumento de respeto a los Derechos Humanos. Uno de los Estados que ha hecho esta manipulación maniquea ha sido el Reino Unido. En América Latina, lo utiliza como bastión para sostener la ocupación de las Islas Malvinas y su proyección de poder hacia la Antártida. Sin embargo, menos conocida es su estrategia en el Océano Índico, en connivencia con su aliado histórico, los Estados Unidos. Este artículo se propone analizar las manipulaciones del derecho internacional que ha realizado el Reino Unido respecto del Estado de Mauricio y la población del atolón Diego García, donde ha violado flagrantemente los derechos humanos, y, al mismo tiempo, qué herramientas de derecho internacional han utilizado los violentados para defenderse de la prepotencia colonial.
