Abstract

A pesar de su título, la Ley 12/2023, de 24 de mayo, no supone el reconocimiento legislativo de un derecho a la vivienda, de manera que no puede considerarse cumplida la Resolución Parlamento Europeo de 21 de enero de 2021 sobre el acceso a la vivienda digna y asequible para todos y, en consecuencia, tampoco que se garantice este derecho, declarado como un derecho fundamental en la STJUE 10 de septiembre de 2014 (asunto C-34/13; Monika Kušionová y SMART Capital, a.s.). El legislador español no configura el derecho al disfrute de una vivienda como un derecho subjetivo ejercitable frente a los poderes públicos y ello pese al reconocimiento meramente formal del derecho «a disfrutar de una vivienda digna y adecuada, en los términos dispuestos por esta Ley» (art. 8.1 de la Ley 12/2023), que se concibe como un instrumento al servicio de las Administraciones Públicas para alcanzar los objetivos marcados en sus planes; al tiempo que se imponen ciertos límites a los propietarios de vivienda (especialmente en el caso de los grandes tenedores). Estos límites se vinculan, particularmente, al deber del propietario de destinar la vivienda al uso habitacional o residencial que le es propio y a proteger a ocupantes de una vivienda en supuestos de vulnerabilidad económica.
