
El objetivo principal del texto es analizar cuál ha sido la postura de la Suprema Corte de Justicia de la Nación en México respecto al derecho a la privacidad de los servidores públicos en las redes sociales frente al derecho de acceso a la información que tienen las personas. Lo anterior, permitirá identificar si existe un choque entre estos derechos y en su caso determinar cuál es la regla para la solución que el máximo tribunal del país estableció para resolver el caso. Para llevar a cabo lo anterior, se emplearon dos conceptos señalados por Aharon Barak, el supuesto de hecho y la cláusula de aplicación de los derechos fundamentales, lo que permitirá saber si existen límites a alguno de los derechos en cuestión a partir del análisis de la sentencia con motivo del Amparo en Revisión 1005/2018, para cumplir con el objetivo señalado. Por último, se presentan algunas ideas a modo de conclusión.
