En defensa de un derecho general a la Igualdad

Abstract

Este artículo examina las diversas formas que adopta el derecho a la igualdad en disposiciones nacionales e internacionales, distinguiendo entre aquellas de naturaleza “accesoria” - que protegen frente a la discriminación solo en relación con ciertos derechos reconocidos - y las de “aplicación general”, que abarcan todos los actos estatales. A partir de esta clasificación, se argumenta que tanto los catálogos cerrados de criterios prohibidos como los abiertos presentan limitaciones para garantizar una protección integral. Frente a ello, se plantea la necesidad de un derecho general a la igualdad, cuya existencia se encuentra implícita, por ejemplo, en el artículo 24 de la Convención Americana sobre Derechos Humanos (CADH). A través del análisis del sistema alemán, en especial el artículo 3 de su Ley Fundamental, se justifica cómo dicho derecho general ofrece un marco más amplio y eficaz para valorar la igualdad y combatir discriminaciones que escapan a los listados tradicionales. Se sostiene que interpretar coherentemente la CADH implica reconocer la dimensión general del derecho a la igualdad, superando así los límites de las prohibiciones accesorias. Esto fortalecería la protección jurídica frente a tratos injustificados, promoviendo una estructura más robusta de derechos humanos en contextos nacionales e internacionales.
