La evolución jurídica de la igualdad en el bloque de constitucionalidad centroamericano

Abstract

Es cierto que el derecho fundamental a la igualdad se trata de una garantía prevista en disposiciones normativas supranacionales. Desde la gestación de importantes coyunturas críticas en el derecho internacional público, la igualdad representa el punto de partida en la transformación de las sociedades que hoy se han erguido en sistemas políticos republicanos. Sin embargo, también es una realidad que, desde el punto de vista jurídico, los efectos de prestación y garantía que resguarda el derecho fundamental a la igual presentan diferenciaciones territoriales. En un primer momento, esta contribución académica presenta los diseños constitucionales centroamericanos en cuanto a la previsión normativa del derecho a la igualdad; para, en un segundo momento, problematizar acerca de las implicaciones diferenciadas de tutela, garantía y prestación que enfrenta la ciudadanía en dicha región. Este análisis busca posicionar que, aún y cuando los ordenamientos jurídicos han constitucionalizado a la igualdad como derecho, persisten desigualdades a las que el derecho les ha resultado ser insuficiente.
