Abstract

El informe pericial para su admisión formal como medio de prueba en la etapa intermedia del proceso penal, conforme a las reglas previstas en el código procesal del 2004, no un requisito la verificación de la calidad epistemológica de sus instrumentos, métodos y resultados, pues solo se requiere que sea pertinente, útil y conducente. Esta situación permite que aquellas aun cuando en su elaboración utilicen teorías contrarias a las establecidas por la comunidad científica, sean admitidas para su actuación en juicio, desconociéndose el perjuicio (sobrevaloración del conocimiento científico) que ocasionan en la actuación de los jueces al momento de resolver sus casos, los cuales inciden potencialmente en las condenas o absoluciones erradas a lo que está expuesto el sistema judicial. El objetivo de este artículo se circunscribe en examinar las posibilidades doctrinarias y teóricas para la adopción del modelo de control de admisibilidad científica de los informes periciales en la etapa intermedia, en la que se analice para su admisión la calidad y fiabilidad científica, a fin de obtener su capacidad resolutiva propuesta para el caso; concluyéndose en la posibilidad de incorporar este modelo al sistema procesal penal peruano, aunado a los criterios de admisibilidad procesal establecidos en la norma.
