Abstract

In questo libro pubblicato in Spagnolo sotto il titolo “URBANIZACIONES CERRADAS RESIDENCIALES, PERSPECTIVAS DE DERECHO URBANÍSTICO Y DE DERECHO CIVIL”, si studiano le urbanizzazioni con perimetro chiuso e sorvegliato in Argentina, chiamate in inglese “gated community”, in cui le classi benestanti della società si sono isolate dal resto della città. Nei due primi capitoli si effettua una ampia considerazione dei gravi problemi sociali e urbanistici che hanno determinato lo sviluppo di questo nuovo habitat in Argentina, problemi non considerati praticamente dai giuristi e sottolineato dai sociologi e urbanisti. Si continua con l’analisi della giurisprudenza argentina in contrasto con la giurisprudenza degli Stati Uniti, l’ordinamento urbanistico di importanti comuni argentini, e finalmente gli aspetti civilistici in cui si illustrano le controversie dottrinarie rispetto al tipo di diritti reali applicabili, senza dimenticare il diritto comparato, specialmente il diritto francese che scoraggia questo tipo di sviluppo. Il libro contiene un’appendice con il testo completo della normativa urbanistica dei comuni e dei modelli di regolamenti e statuti utilizzati nelle diverse città.
