Abstract

EL artículo aborda el régimen sancionatorio por infracciones a los derechos de los consumidores en el sector inmobiliario en Colombia, enfocándose en la eficacia de la facultad sancionatoria administrativa de la Superintendencia de Industria y Comercio. El análisis se centra en determinar hasta qué punto dicha facultad cumple un rol disuasorio efectivo frente a los administrados, a través del concepto de disuasión marginal. Para ello, se realiza un estudio cuantitativo que examina los costos y beneficios potenciales que enfrentan los infractores en relación con las conductas ilegales cometidas. Los hallazgos sugieren que el ejercicio de la facultad sancionatoria por parte de la autoridad de consumo en el sector inmobiliario resulta ineficaz, pues las multas impuestas no generan el efecto disuasorio esperado, lo cual se debe, en gran medida, a su bajo monto y a que muchas sanciones derivan de incumplimientos de órdenes. En conclusión, el artículo subraya la necesidad de replantear y reestructurar la forma en que la autoridad ejerce sus funciones sancionatorias, proponiendo una serie de reformas orientadas a maximizar las facultades administrativas conferidas. Solo de esta manera se podrán alcanzar plenamente los objetivos del Estatuto del Consumidor, garantizando una protección efectiva y real de los derechos de los consumidores en el sector inmobiliario.

This article addresses the sanctioning regime for violations of consumer rights in the real estate sector in Colombia, focusing on the effectiveness of the administrative sanctioning authority of the Superintendence of Industry and Commerce. The analysis centers on determining the extent to which such authority plays an effective deterrent role against the regulated entities, through the concept of marginal deterrence. To that end, a quantitative study is conducted, examining the potential costs and benefits faced by offenders in relation to the illegal conduct committed. The findings suggest that the exercise of the sanctioning authority by the consumer protection body in the real estate sector is ineffective, as the fines imposed fail to generate the expected deterrent effect, largely due to their low value and the fact that many sanctions stem from noncompliance with previously issued orders. In conclusion, the article underscores the need to rethink and restructure the way the authority exercises its sanctioning powers, proposing a series of reforms aimed at maximizing the administrative powers granted. Only in this way can the objectives of the Consumer Protection Statute be fully achieved, ensuring real and effective protection of consumer rights in the real estate sector.
