El presente trabajo contiene un desarrollo del análisis jurisprudencial efectuado sobre varias decisiones en sede de tutela y control de constitucionalidad referente al manejo y el alcance del principio de la autonomía sindical como especie de la libertad sindical. Se ha elegido el estudio de las decisiones de la Corte Constitucional dado el carácter fundamental de la libertad sindical y la aplicación del bloque de constitucionalidad en relación con las normas internacionales del trabajo y su incidencia en el derecho laboral colectivo interno. La autonomía sindical es un elemento característico de la funcionalidad de las organizaciones sindicales, sin embargo, su aplicación y limites no ha sido claramente establecido por parte del legislador, lo que ha obligado a que en asuntos de tutela y de constitucionalidad, la autoridad judicial delimite el alcance de ese elemento y establezca las situaciones en las que los sindicatos tienen capacidad de autorregulación y autoorganización.

This paper contains a development of the jurisprudential analysis made on several decisions in tutela and constitutionality control regarding the handling and scope of the principle of union autonomy as a species of freedom of association. The study of the decisions of the Constitutional Court has been chosen given the fundamental nature of freedom of association and the application of the block of constitutionality in relation to international labor standards and their impact on domestic collective labor law. Trade union autonomy is a characteristic element of the functionality of trade union organizations, however, its application and limits have not been clearly established by the legislator, which has forced the judicial authority to delimit the scope of this element and to establish the situations in which trade unions have the capacity for self-regulation and selforganization in matters of tutela and constitutionality.
