Abstract

Los máximos órganos de justicia de los pocos países que han despenalizado la eutanasia y/o el suicidio médicamente asistido han basado sus decisiones principalmente en la ponderación entre los derechos fundamentales a la dignidad humana y al libre desarrollo de la personalidad frente al derecho fundamental a la vida. Esta tesis de grado propone un enfoque diferente que podría servir como base para futuros procesos de despenalización: la atipicidad objetiva de los procedimientos médicos de eutanasia y suicidio médicamente asistido en entornos sanitarios. A lo largo de esta obra, se realiza un exhaustivo estudio dogmático que abarca los antecedentes, clasificación y respuesta penal a la eutanasia y al suicidio médicamente asistido, así como su interacción con la medicina y el derecho, explorando temas como la bioética, el bioderecho, el acto médico y el derecho a la muerte digna. Además, se ofrece una revisión de la historia y la realidad jurídica de los países donde estos dos procedimientos están permitidos, culminando en un examen de tipicidad objetiva de la acción del profesional de la salud en la muerte médicamente asistida, denominación que comprende tanto a la eutanasia como al suicidio médicamente asistido.

The highest courts in the few countries that have decriminalized euthanasia and/or assisted suicide have primarily based their decisions on balancing the fundamental rights to human dignity and the free development of personality against the fundamental right to life. This thesis proposes a different approach that could inform future decriminalization efforts: the objective atypicality of medical procedures for euthanasia and assisted suicide within healthcare settings. This work conducts a comprehensive dogmatic study, addressing the background, classification, and legal responses to euthanasia and assisted suicide, while also examining their interaction with medicine and law. Key topics explored include bioethics, biolaw, medical acts, and the right to a dignified death. Additionally, the thesis offers a review of the historical and legal contexts in countries where these procedures are allowed, culminating in an examination of the objective typicality of actions taken by healthcare professionals in medical assistance in dying, a term that encompasses both euthanasia and assisted suicide.
