En Colombia, el derecho a la propiedad privada goza de un generoso reconocimiento constitucional y legal. De hecho, en el marco de una relación arrendaticia, el propietario/arrendador tiene a su disposición mecanismos de protección judicial como el proceso de restitución de bien inmueble arrendado y la diligencia de desalojo, dentro de los cuales, incluso, se limita el derecho de contradicción y de defensa del arrendatario, quien debe probar el pago de las cuotas de arriendo para tener la oportunidad de contestar la demanda y defenderse de los cargos que le atribuyen. Este artículo problematiza esa situación respecto a su relación con la protección del derecho a una vivienda digna, esto, en el sentido de mirar la controversia más allá de los estrechos linderos de las normas civiles y adoptar, en su lugar, un enfoque diferencial que brinde la oportunidad de defender sus derechos a arrendatarios que estén en condiciones de vulnerabilidad o marginalidad.

In Colombia, the right to private property enjoys generous constitutional and legal recognition. In the context of a rental relationship, the owner/lessor has access to judicial protection mechanisms such as the process of restoring a leased property and the eviction procedure, within which even the tenant's right to contradiction and defense is limited. The tenant must prove the payment of rent installments to have the opportunity to respond to the lawsuit and defend against the charges made. This article problematizes this situation in relation to the protection of the right to dignified housing, aiming to look beyond the narrow boundaries of civil regulations and adopt, instead, a differential approach that offers the opportunity to defend the rights of tenants who are in vulnerable or marginalized conditions.
