Abstract

En atención a la dificultad que representa para el derecho internacional la ausencia de regulación uniforme de la Inmunidad de Jurisdicción y de Ejecución de los Estados, y las consecuencias de la renuncia de la misma frente a una situación de peligro extremo o estado de necesidad, este documento presenta una visión analítica sobre el alcance de la Inmunidad Estatal y la obligación de los Estado de proteger a su población en situaciones de peligro extremo y estado de necesidad. Los Estados, a pesar de haber renunciado a la Inmunidad Estatal válidamente, deben poder hacerla valer cuando se encuentren en una situación apremiante. ; In view of the difficulty which represents the lack of uniform regulation of Immunity of Jurisdiction and Enforcement of States to international law, and the consequences of waiving Immunity when faced to a situation of distress or necessity, this paper presents an analytical view on the scope of Immunity of Jurisdiction and Enforcement and the obligation of States to protect its population in situations of distress and necessity. States, despite having waived their immunity of Jurisdiction and Enforcement validly, should be able to enforce it when they are in such a situation. ; Abogado (a) ; Pregrado
