Rapsódia sobre teorias sistémicas do direito

Abstract

Este estudo tem como objetivo a exposição sumária das teorias sistémicas do Direito, desde a sua fonte às diferentes interseções com outras ciências sociais e humanas. Procura-se, em particular, descrever (a)criticamente os principais traços das teorias autopoiéticas sociojurídicas de Luhmann e Teubner, incluindo as suas diversas relações antissimétricas, transitivas e autorreferenciais, bem como o diálogo que provoca com outras teses aparentemente semelhantes. Este trabalho pretende ser o primeiro de dois capítulos. A segunda parte consistirá na apresentação de uma nova perspetiva, por parte do autor, de uma visão sistémica do Direito.
