
The «referendum autonómico», that is, the appeal to the opinion of the electorate in the Autonomous Communities (CCAA), has gained notoriety in recent times as a result of its legal treatment in the two CCAA certainly most significant: País Vasco and Cataluña. In its consultative form, both of them have been declared unconstitutional, but not, in the case of Cataluña, as referred to mandatory statutory reform. This paper analyzes the two decisions of the Constitutional Court about the matter, with a critical view of the second one, and notes the tendency to breach the order, at least in its most literal and therefore more logical, for the consultative referendum desired by the Communities because of its obvious political significance.El referéndum como forma de apelación al parecer del cuerpo electoral en las Comunidades Autónomas, ha adquirido notoriedad en los últimos tiempos, debido a los tratamientos jurídico-políticos del mismo que se han llevado a cabo en las dos Comunidades Autónomas sin duda más significadas: el País Vasco y Cataluña. Ambos tratamientos han sido declarados inconstitucionales por el Tribunal Constitucional en su forma consultiva, no así, en el segundo de los casos, en su forma preceptiva como requisito de la reforma estatuaria. Este trabajo analiza desde un punto de vista formal las dos decisiones del Tribunal Constitucional recaídas, con una visión crítica de la segunda de ellas, y constata la tendencia al incumplimiento del ordenamiento —al menos en su sentido más literal y por ello más lógico— respecto de los referendos consultivos pretendidos por las Comunidades en virtud de la evidente significación política que es propia de tal instrumento consultivo.
