Abstract

Resulta cada vez más habitual que las conductas descritas de enaltecimiento del terrorismo y de humillación y descrédito de sus víctimas previsto en el art. 578 CP y las constitutivas del llamado «delito de odio» del art. 510 CP se realicen mediante el empleo de Internet o redes sociales. No debe extrañar, por ello, que en la más reciente jurisprudencia sobre delitos de odio se haga eco de la cuestión que acaba de ser planteada de forma cada vez más habitual. No en vano, algunas resoluciones reconocen como indicadores de la eventual relevancia típica de la conducta, por ejemplo, el carácter abierto o cerrado de la red, el número de seguidores del agente, el número de retuits del mensaje o la habitualidad del perfil del enjuiciado. Ello está sucediendo, no obstante, en mucha mayor medida en relación con el delito de enaltecimiento del terrorismo y humillación y descrédito de sus víctimas previsto en el art. 578 CP (Ciberterrorismo), que a propósito del delito de odio del art. 510 CP (Ciberodio). A continuación se exponen críticamente las principales vicisitudes de ambos contextos jurisprudenciales.
