
Kant no sólo es un pensador jurídico moderno, sino también provocativo en lo que respecta a su defensa de la ley del talióny de la pena de muerte. El principio que rige la justicia penal de Kant es el de la igualdad entre el delito y la pena, y frente al asesinato no habría para él otra pena equivalente que la de la muerte. Con ello se opone a Beccaria y a su concepción del contrato social, y su respuesta resulta significativa en un plano estrictamente jurídico.
