Abstract

O estágio atual da doutrina administrativista não permite a insindicabilidade judicial das escolhas regulatórias, com base na mera invocação de fórmulas, como “ato discricionário”, “discricionariedade técnica”, “conceitos jurídicos indeterminados”, tradicionalmente utilizadas pelos tribunais para se escusar de apreciar assuntos técnicos e muitas vezes polêmicos sob a perspectiva jurídica. Verificada a existência de limitações relativas à capacidade institucional do Judiciário na apreciação das escolhas regulatórias, defende-se a inserção de uma visão institucional em relação ao controle judicial da discricionariedade, o qual não deve ser excluído a priori em qualquer situação de interpretação e aplicação de certa lei pela Administração Pública, embora deva ser adotada uma deferência saudável às opções dos entes reguladores do mercado financeiro.
